“WA4STEAM” is deeply committed to complying with Spanish and European regulations on the protection of personal data, as well as the implementation of the security measures set out in the General Data Protection Regulation (GDPR) (EU) 2016/679, of 27 April, and in Organic Law 3/2018,  of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD and GDD, hereinafter LOPD).

In accordance with these regulations, we inform you that the use of our website may require you to provide certain personal data through contact forms, or by sending emails, and that these will be processed by “WA4STEAM“, Data Controller, whose data are:

Collection and Processing of Personal Data

Personal data is any information relating to a person: name, email, address, telephone number, NIF/NIE, etc. including certain information automatically stored for technical reasons when you visit our website, such as the IP address assigned by their Internet service provider.

WA4STEAM only collects the reasonable minimum personal data, necessary to respond adequately to the requests made by the individuals or to be able to carry out its activity; no specially categories of data are collected at any time. Under no circumstances will the data be used differently than the purpose for which it was collected.

Contact/Email Forms

Purpose: To respond to your request for information made through our contact form(s).

Legitimation: The legal basis that legitimizes this processing is the controller’s legitimate interest.

Transfer of data: Personal data will be processed through servers managed by ProximaHost and Comvive, which will be considered as Data Processors.

Membership Forms

Purposes:

  1. Evaluate and study your candidacy to be part of the association.
  2. Respond to the acceptance or denial of membership in the association.
  3. Carry out the administrative management derived from the registration process.

Legitimation: The legal basis that legitimizes this processing is the User’s consent, which may be revoked at any time.

Minors

Only persons over the age of 14 may provide personal data on this website. As required by the LOPD and GDD, in the case of minors under 14 years of age, the consent of their parents or guardians will be mandatory for us to process their personal data.

On the other hand, only people over 18 years of age participate in our activities. In the case of minors under 18 years of age, the consent of their parents or legal guardians will be mandatory unless the minor is emancipated.

Security Measures

Users of the “WA4STEAM” website are informed that the security, technical and organisational measures at our disposal have been adopted to prevent the loss, misuse, alteration, unauthorised access and theft of data, and thus guarantee the confidentiality, integrity and quality of the information contained therein.  in accordance with the provisions of current data protection regulations. The personal data collected in the forms are processed only by members of “WA4STEAM” or the designated Data Processors.

The “WA4STEAM” Website also has SSL encryption, which allows the individuals to securely send their personal data through the contact or registration forms on the website.

Veracity of the data

The individuals declares that all the data provided by him is true and correct and undertakes to keep them updated. The User will be responsible for the veracity of their data and will be solely responsible for any conflicts or litigation that may result from the falsity of the same. It is important that, in order for us to keep the personal data up to date, the User informs “WA4STEAM” whenever there has been any change in the same.

Transfer of data

“WA4STEAM” will not transfer or communicate your data to any third party, except in the cases provided for by law or when it is strictly necessary. Specifically, the data may be transferred to:

  1. Technology or IT Service Providers
  2. Payment Service Providers
  3. Courier and parcel companies
  4. Third parties or intermediaries, in their capacity as service providers, who operate on our own behalf (agency, consultancy, etc.).

Data transfers will take place in accordance with the strictest confidentiality, using the necessary measures, such as signing confidentiality agreements, or adhering to their privacy policies established on their respective websites. The User may refuse the transfer of his/her data to the Data Processors, by written request, by any of the means referred to above.

In addition, in those cases where it is necessary, Customer data may be transferred to certain bodies, in compliance with a legal obligation: Spanish Tax Agency, Labour Inspectorate, etc.

Exercise of User Rights

The LOPD and the GDPR grant data subjects the possibility of exercising a series of rights related to the processing of their personal data. To do so, the User must send an email to wa4steam@wa4steam.com, providing documentation that proves their identity (ID card or passport), or by written communication to the address that appears in our Legal Notice. This communication must reflect the following information: name and surname of the User, the purpose of the request, the address and the supporting data.

The exercise of rights must be carried out by the User himself. However, they may be executed by a person authorised as the User’s legal representative, provided with the documentation that proves such representation.

The User may request the exercise of the following rights:

  1. The right to request access to personal data, which is the  right to obtain information about whether your own personal data is being processed, the purpose of the processing, if any, that is being carried out, as well as the information available on the origin of such data and the communications made or planned to be made of them.
  2. The right to request its rectification, in case the personal data is incorrect or inaccurate, or deletion of the data that turns out to be inadequate or excessive.
  3. The right to request the restriction of  its processing, in which case only the data strictly necessary for the exercise or defence of claims will be kept by “WA4STEAM”.
  4. Right to object to processing: refers to the right of the data subject not to have  his/her personal data processed or to cease processing in cases where his/her consent is not required for the processing, that they are commercial prospecting files or that have the purpose of making decisions concerning the data subject and based solely on the automated processing of his/her data,  unless for legitimate reasons or the exercise or defence of possible claims they have to be further processed.
  5. Right to data portability  : in case you want your data to be processed by another company, “WA4STEAM” will provide you with the portability of your data in exportable format.

In the event that consent has been granted for a specific purpose, the User has the right to withdraw consent at any time, without affecting the lawfulness of the processing based on consent prior to its withdrawal.

We undertake to exercise all these rights within the maximum legal period (1 month).

If a User considers that there is a problem with the way in which “WA4STEAM” is handling their data, they can direct their complaints to the association or contact the corresponding data protection authority, the Spanish Data Protection Agency being the one indicated in the case of Spain.

Data retention

The personal data of Users who use the contact form or who send us an email requesting information will be processed for the time strictly necessary to respond to the request for information, or until the consent granted is revoked.

The Clients’ personal data will be processed until the end of the contractual relationship. The retention period of personal data will be the minimum necessary, and may be maintained up to:

  1. 4 years: Law on Infringements and Sanctions in the Social Order (obligations regarding affiliation, registrations, cancellations, contributions, payment of salaries, etc.); Arts. 66 et seq. of the General Tax Law (accounting books, etc.)
  2. 5 years: Art. 1964 Civil Code (personal actions without special time limit)
  3. 6 years: Art. 30 of the Commercial Code (accounting books, invoices, etc.)
  4. 10 years: Art. 25 Law on the Prevention of Money Laundering and Financing of Terrorism.
  5. No deadline: disaggregated and anonymized data.

The data of Users who subscribe to newsletters or similar methods of communication, will be kept until the consent granted is revoked.

In the case of processing of candidates’ data (C.V.), “WA4STEAM” may keep their CV stored for a maximum of two years in order to incorporate it into future calls, unless the candidate states otherwise.

Social Media

“WA4STEAM” has a profile on some of the main social networks on the Internet (Twitter, LinkedIn), recognizing itself in all cases as the Data Controller of the data of its followers, fans, subscribers, commentators and other User profiles (hereinafter, followers) published by “WA4STEAM”.

The purpose of the data processing  by “WA4STEAM”, when not prohibited by law, will be to inform its followers about its activities, by any means that the social network allows, as well as to provide personalized user service. The legal basis for this processing is the consent of the data subject, which may be revoked at any time.

Under no circumstances  will “WA4STEAM” extract data from social networks, unless the User’s consent to do so has been obtained in a timely and express manner (for example, to carry out a contest).

Personnel Selection

WA4STEAM does not have employees. If in the future it were to hire personnel, the applicant who sends electronic communications  to “WA4STEAM”, in order to access its personnel selection processes , authorizes Wa4STEAM to analyze the documents sent (e.g., the C.V.), all the content that is directly accessible through Internet search engines (e.g., Google), the profiles maintained in professional social networks (e.g.,  LinkedIn), the data obtained in the entrance exams and the information you reveal in the job interview, with the aim of assessing your candidacy and being able, where appropriate, to offer you a job. In the event that the candidate is not selected, “WA4STEAM” may keep his/her CV stored for a maximum of two years, to incorporate it in future calls, unless the candidate states otherwise. The legal basis for this processing is the consent of the data subject, which may be revoked at any time.

Confidentiality

The information provided by the User will, in any case, be considered confidential, and may not be used for purposes other than those described herein. “WA4STEAM” undertakes not to disclose or disclose information about the User’s claims, the reasons for the advice requested or the duration of their relationship with the User.

Validity

This privacy and data protection policy was drafted  on 20 February 2024. It may vary depending on the changes in regulations and jurisprudence that take place, and it is the responsibility of the owner of the data to read the updated document, in order to know their rights and obligations in this regard at all times.
